You Have Three Years, and Sometimes Much Less

Most Mississippi personal injury claims must be filed within three years of the injury under Mississippi Code § 15-1-49. Miss it and the claim is gone regardless of how badly you were hurt or how clearly the other side was at fault.

Three years sounds like plenty of room. In practice the exceptions are what catch people:

Claims against a government entity.


One year to file, plus a written notice of claim that must be served on the entity 90 days before suit. Hit a city vehicle or fall on state property and you are on this track, not the three-year one.

Medical malpractice.


Two years from when the claim accrued, with a separate pre-suit notice requirement.

Wrongful death.


Three years, but running from the date of death rather than from the underlying injury.

Injured minors.


The clock is generally paused until the child turns 21, with exceptions.

Separately, evidence has its own timeline. Surveillance footage gets overwritten, vehicles get repaired or scrapped, witnesses move, and commercial carriers purge records once retention periods lapse. The legal deadline is rarely the reason to move quickly. The evidence is.

  • How much does a personal injury lawyer cost in Mississippi?

    Nothing up front. Injury cases are handled on a contingency fee basis, meaning the fee is a percentage of what we recover and you owe no attorney's fee if the case does not produce a recovery. The percentage and how case expenses are handled are both spelled out in writing before you retain us.

  • Should I talk to the other driver's insurance company before hiring a lawyer?

    You are not required to give the other side's insurer a recorded statement, and doing it early rarely helps you. Adjusters take those statements before people know the extent of their injuries, then use the early description to argue the injury was minor. You do have to cooperate with your own insurer under your policy, which is a different obligation.

  • How long will my injury case take?

    It depends on the severity of the injury and whether the insurer disputes liability. Cases with clear fault and completed medical treatment can resolve in a few months. Cases involving serious or permanent injuries generally take longer, partly because the full cost of the injury cannot be calculated until treatment stabilizes. Settling before that point is how people end up undercompensated.
